These Terms of Service ("Terms") govern your use of the OPTIO Women's Health website and telehealth services, which are operated by Optio Women's Health ("we", "us", or "our"), a company registered in California, USA. By using this website or submitting a consultation form, you agree to these Terms. Our Privacy Statement, Shipping Policy, Cancellation Policy, and Refund Policy form part of these Terms.

About Our Services

Optio Women's Health is a California-based provider of abortion medication by telehealth, operating in accordance with California’s shield law — see California Shield Law Protections below.

Not for Emergencies

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. This website and our telehealth services are not monitored continuously and must not be used to report an emergency.

Who May Use Our Services

Providing inaccurate health information may result in a prescription that is unsafe for you. Requests that cannot be verified as meeting these requirements will be declined.

Medical Services and the Doctor–Patient Relationship

Our services are provided by licensed medical doctors. Completing the online consultation form and submitting payment is a request for care; it is not a guarantee that medication will be prescribed.

A licensed physician reviews every request. The physician may decline the request, request more information, or ask to speak with you before making a decision. Clinical judgment rests entirely with the physician, and no part of these Terms obliges a physician to prescribe.

Information on this website is general and is not a substitute for individualized medical advice.

Orders

When you submit the consultation form and pay, you are making a request for care and an offer to purchase under these Terms, and you authorize us to charge your selected payment method for the total shown at checkout. Your order is accepted when a licensed physician approves your request.

Before acceptance, we may decline an order for legitimate reasons — for example, if you do not meet the requirements above, the physician does not approve the request, payment cannot be authorized, we cannot ship to the address given, we reasonably suspect fraud, or an obvious pricing error affected the order. If your order is declined and has not shipped, you receive a full refund.

After acceptance, we may cancel an order if circumstances beyond our reasonable control prevent us from fulfilling it, or where cancellation is required to meet a legal obligation. If that happens before shipment, you receive a full refund.

Pricing and Payment

Billing Questions

Tell us promptly if your payment details change or if you believe a charge is unauthorized or incorrect. We will investigate and correct genuine billing errors, and we will notify you before charging any corrected amount. If a payment method is reported compromised, we will suspend further charges to it while the matter is clarified.

If you see a charge you do not recognize, please contact us before disputing it with your bank — charges from us appear as OPTIO WOMEN'S HEALTH, and we can usually identify and resolve the charge the same business day.

Shipping, Cancellations, and Refunds

These are covered in full by our Shipping Policy, Cancellation Policy, and Refund Policy, each of which forms part of these Terms.

Risk of loss passes to you when you, or someone you designate, take physical possession of the package. If a package is confirmed lost in transit or arrives damaged, our Shipping Policy provides for free reshipment.

Text Messages and Email

With your consent, we send transactional messages about your order — such as tracking information — by email or SMS, and, only if you separately opt in, occasional informational messages. Consent to marketing messages is never a condition of purchase. We do not charge for these messages, but message and data rates may apply, as determined by your mobile carrier.

To stop text messages, reply STOP to any message we send; reply HELP for help. To stop marketing email, use the unsubscribe link in the message. We will not share or sell your mobile phone number or your SMS consent with any third party for their marketing purposes. See our Privacy Statement.

Privacy

Our handling of your personal and health information is described in our Privacy Statement. Information you submit through the consultation form is encrypted and stored on HIPAA-compliant infrastructure.

Intellectual Property

The content, design, and materials on this website are owned by OPTIO Women's Health or its licensors and may not be reproduced without permission. We grant you a limited, revocable, non-transferable license to access and use the website for your personal use. You may refer to us in a factual and truthful manner, but you may not use our name or logo in a way that implies endorsement or affiliation without our prior written consent.

Feedback and Reviews

If you send us feedback, suggestions, or reviews, you grant us a royalty-free, perpetual license to use them — including to improve and promote our services — without obligation or compensation to you. You keep ownership of what you wrote.

Reviews must reflect your own genuine experience and must not contain unlawful, deceptive, defamatory, or misleading content, or other people's personal information. We may remove reviews that violate these rules.

Website Information and Availability

We aim to keep the information on this website accurate and up to date, but occasional errors, inaccuracies, or omissions may occur, and we may correct or update material at any time.

We may update, improve, or change the website at any time. The website may occasionally be unavailable due to maintenance, technical issues, or events beyond our reasonable control; we are not liable for temporary unavailability. None of this affects orders already accepted or the policies that apply to them.

Accessibility

We are committed to making our website accessible to everyone, and we follow the Web Content Accessibility Guidelines (WCAG) 2.2 Level A. If you encounter an accessibility barrier, please contact us and tell us which page it happened on and what went wrong — including, if relevant, the device and assistive technology you were using — and we will work to fix it.

This website links to third-party sites and services that we do not operate, such as scheduling tools and informational resources. We are not responsible for their content, availability, or privacy practices; links are provided for convenience and are not endorsements. Your use of a third-party site is governed by that site's own terms and policies.

Events Outside Our Control

We are not responsible for delay or failure to perform caused by events outside our reasonable control — for example, natural disasters, internet or carrier outages, or failures of third-party services. If such an event affects delivery of your order, we will contact you to arrange delivery once it is over, or you may cancel and receive a refund for anything not delivered. Such an event does not excuse payment for services and products already provided to you.

Disclaimers

Except as expressly stated in these Terms and as required by law, the website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted or error-free.

Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for the professional services provided by a licensed physician.

Limitation of Liability

To the fullest extent permitted by law, and other than as stated above, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of your use of this website, and our total liability arising out of your use of this website is limited to the greater of the amount you paid for the service giving rise to the claim or $150.

Nothing in this section limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising out of your breach of these Terms, your violation of law, or your violation of the rights of any third party in connection with your use of our services. This does not apply to claims arising from our own breach of these Terms, our negligence, or the professional services provided by a licensed physician.

Dispute Resolution

If you have a dispute with us, please contact us first with a description of the issue and the outcome you are seeking — most concerns can be resolved directly. If we cannot resolve a dispute informally within 30 days of your written notice, either party may pursue it in court.

To the extent permitted by applicable law, disputes will be resolved on an individual basis; neither of us will bring or participate in a class, representative, or consolidated action against the other. Nothing in this section prevents either party from seeking injunctive relief to protect confidential information or intellectual property.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that proceeds to court will be brought in the state or federal courts located in Sonoma County, California, and you and we each consent to the jurisdiction of those courts.

California law provides legal protections for patients who obtain, and providers who deliver, reproductive health care in California — including protections against certain out-of-state legal actions. These are commonly known as California’s shield law protections.

Changes to These Terms

We may update these Terms from time to time. The "last updated" date above reflects the current version. Changes apply to orders placed after the date they are posted; for material changes we will give reasonable advance notice where the law requires it.

Other Terms

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force. A failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our written consent; we may transfer ours in connection with a merger, acquisition, or sale of assets, provided your rights are not reduced as a result. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the website and our services. In these Terms, "including" means "including but not limited to"; headings are for convenience only. Sections that by their nature should survive — including the disclaimers, limitation of liability, and dispute resolution — survive after these Terms end.
